1. Acceptance of Terms

By creating an account or using BuySellBid.com ("the Site", "we", "us", "our"), you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our platform.

We reserve the right to modify these terms at any time. Continued use of the Site after changes constitutes acceptance of the new terms.

2. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current and complete information during registration and to update such information to keep it accurate. We reserve the right to suspend or terminate accounts that contain false information.

One person may only maintain one active account. Duplicate accounts may be removed without notice.

3. Membership Plans

BuySellBid operates on a flat-fee membership model. We charge sellers a recurring monthly or yearly membership fee and collect zero commissions on sales.

Billing: Membership fees are billed in advance on a monthly or yearly basis. All fees are non-refundable except where required by law.

Auto-renewal: Your membership will automatically renew at the end of each billing period unless cancelled. You may cancel at any time from your dashboard.

Free Trial: New accounts receive a 14-day free trial. No credit card is required to start your trial. After the trial period, you must select a paid plan to continue listing items.

Plan Changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the next billing cycle.

4. Listings & Products

Sellers are solely responsible for the accuracy and legality of their listings. All listings must accurately describe the item being sold, including condition, photos, and pricing.

By creating a listing, you represent that you have the legal right to sell the item and that the item does not infringe on any third-party intellectual property rights.

We reserve the right to remove any listing that violates these terms or that we determine, in our sole discretion, is inappropriate for the platform.

Listings may not contain misleading information, fraudulent claims, or deceptive practices of any kind.

5. Buying

By purchasing an item, you enter into a binding contract with the seller. Buyers are responsible for reading all listing details, including shipping costs and return policies, before making a purchase.

BuySellBid is a marketplace platform and is not a party to transactions between buyers and sellers. We are not responsible for the quality, safety, legality, or availability of items listed on the platform.

Buyers should communicate with sellers through our messaging system and keep records of all transactions.

6. Auctions

All bids placed on auction listings are binding. By placing a bid, you agree to purchase the item at that price if you are the winning bidder.

Auction sniping protection: auctions may be automatically extended if a bid is placed within the final minutes of an auction.

Sellers may set a reserve price. If the reserve price is not met, the seller is not obligated to complete the sale.

Bid manipulation, shill bidding, or any other fraudulent auction activity is strictly prohibited and will result in immediate account termination.

7. Payments

BuySellBid does not process payments between buyers and sellers. Buyers and sellers are responsible for arranging payment directly. We recommend using secure payment methods such as PayPal or credit cards that offer buyer protection.

Membership fees are processed securely through Stripe. Your payment information is never stored on our servers.

We are not responsible for payment disputes between buyers and sellers. However, we provide a dispute center to help facilitate resolution.

8. Prohibited Items & Activities

The following items and activities are strictly prohibited on BuySellBid:

• Illegal items or items that require special licensing
• Counterfeit, replica, or unauthorized copies of branded goods
• Weapons, firearms, ammunition, or explosives
• Controlled substances, drugs, or drug paraphernalia
• Adult content or services
• Stolen goods
• Hazardous materials
• Live animals
• Fraudulent listings or misrepresented items
• Spam, phishing, or any form of harassment
• Creating multiple accounts to circumvent bans
• Any activity that violates applicable laws or regulations

Violation of these prohibitions may result in immediate account termination and may be reported to appropriate authorities.

9. Disputes

We encourage buyers and sellers to resolve disputes directly through our messaging system. If a resolution cannot be reached, our Dispute Center is available to help mediate.

BuySellBid's dispute decisions are final but we are not liable for outcomes of disputes between buyers and sellers.

Any legal disputes arising from the use of BuySellBid shall be governed by the laws of the State of Wyoming, USA.

10. Limitation of Liability

BuySellBid is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation of the platform.

To the maximum extent permitted by law, BuySellBid shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

Our total liability to you for any claims arising from these terms shall not exceed the membership fees paid by you in the 12 months preceding the claim.

11. Termination

You may close your account at any time from your dashboard settings. Upon termination, your listings will be removed and your data will be handled in accordance with our Privacy Policy.

We reserve the right to suspend or terminate any account at any time for violation of these terms, with or without notice.
